Terms of Service

1. Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of the Orobas platform, including the website at orobas.gg and any related services (collectively, the “Service”) operated by [ENTITY: pending](“Orobas,” “we,” “us,” or “our”). By creating an account, depositing funds, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You also agree to our Privacy Policy, our Responsible Gambling policy, and our Geographic Restrictions, each of which is incorporated by reference into these Terms.
2. Eligibility
To use the Service, you must:
- Be at least eighteen (18) years of age, or the age of majority in your jurisdiction of residence, whichever is greater. Some jurisdictions require players to be at least twenty-one (21) for wagering activities; you are responsible for confirming the legal age in your jurisdiction. - Be legally permitted to participate in skill-based wagering and real-money or crypto-asset wagering under the laws of your jurisdiction. See Geographic Restrictions for the current list of supported and excluded jurisdictions.
- Have capacity to enter into a binding contract under the laws of your jurisdiction.
- Not be a resident of, or accessing the Service from, any jurisdiction in which the Service is prohibited.
- Not appear on any sanctions list maintained by the United States Office of Foreign Assets Control (OFAC), the European Union, the United Nations, or any other applicable governmental authority.
We may, at our sole discretion, require identity verification (KYC), proof of age, or proof of residence at any time. Failure to provide requested documentation may result in account suspension or termination and forfeiture of pending wagers and balances. [LEGAL REVIEW: forfeiture clauses vary by jurisdiction]
3. Account registration
You register for the Service via an email address through our identity provider (Privy). The Service uses Privy to create an embedded Solana wallet for you on the Solana blockchain. You control your wallet; we do not hold private keys or custody your funds.
You agree to:
- Provide accurate, current, and complete information.
- Keep your account credentials and email account secure. You are responsible for any activity occurring under your account.
- Not create more than one account. We treat duplicate accounts as a violation of these Terms and may close any or all of them at our discretion.
- Not transfer or sell your account. Accounts are personal to you.
- Notify us promptly at support@orobas.gg if you suspect unauthorized access.
4. Game modes and wagering rules
The Service currently offers three game modes:
- Coinflip. A two-player 50/50 wager whose outcome is determined by a verifiable random function (VRF) generated by Switchboard On-Demand inside an Intel SGX enclave and read by an on-chain Solana program. The program reads the first byte of the VRF value and pays the maker if it is even, the taker if it is odd. The operator cannot alter the result or redirect funds.
- Chess. A two-player skill duel matched by ELO rating. Every move is validated by a server-side chess engine; illegal moves are rejected. Game results are recorded in a public PGN and settled on-chain by operator attestation. Chess games are subject to time controls, anti-cheat analysis, and forfeiture for disconnection or timeout.
- Events. Binary (yes/no) wagers on real-world outcomes, with two players matched at equal stakes. Outcomes are determined by an optimistic oracle: a proposer proposes an outcome with a bond, any user may dispute within a fixed window with a counter-bond, and a final arbitrator resolves disputed cases. The operator may resolve in an explicit fallback mode if the optimistic process fails to converge.
All wagers are placed in U.S. Dollar Coin (USDC) on the Solana blockchain. We charge a rake of 4% on the winner's profit (not on the principal). See our House Edge page for worked examples.
By placing a wager, you agree:
- The outcome of each game is determined by the rules of that mode. You will not have recourse to dispute the outcome of a fairly decided game, except as expressly provided in these Terms.
- Wagers, once placed and matched, are final. Funds are escrowed on-chain in a per-game program-derived account; neither you nor the platform can withdraw a matched wager before settlement.
- You will not collude with other players, manipulate game outcomes, exploit software bugs, or use automated systems, engine assistance, or third-party tools to gain an unfair advantage.
- Specifically in chess, the use of computer engine analysis (Stockfish, AlphaZero, or similar) during a live game is a material breach of these Terms. Anti-cheat detection results may lead to forfeiture, account suspension, and refund of the opponent's stake from the offending player's account.
5. Deposits and withdrawals
Deposits. Deposits are made by sending USDC to your Privy-managed Solana wallet. We credit your platform balance once the deposit is finalized on the Solana network. We have no control over the deposit transaction itself; deposit failures, partial deposits, or transactions to incorrect addresses are not our responsibility.
Withdrawals. You may withdraw your available balance at any time, subject to: (a) clearance of any in-flight deposits; (b) completion of any pending wagers; (c) successful identity verification where required; and (d) any temporary holds imposed pursuant to anti-fraud, anti-money-laundering, or responsible-gambling policies.
You acknowledge that USDC is an asset issued on the Solana blockchain by a third party (Circle). Orobas does not issue USDC and is not responsible for the value, redemption, or stability of USDC. Blockchain-network fees and congestion may delay transactions. We do not pay or rebate network gas fees.
Dormant accounts. Accounts with no log-in or transaction activity for twenty-four (24) consecutive months may be designated dormant. We will attempt to contact you at your registered email address before any action is taken on a dormant balance. 6. KYC, AML, and sanctions compliance
We may at any time require you to complete identity verification (KYC) through our verification partner (Persona). Triggers include, without limitation:
- Cumulative deposits or withdrawals exceeding certain thresholds. [LEGAL REVIEW: thresholds per jurisdiction; typical US FinCEN $2,000 cumulative]
- Unusual account activity flagged by our monitoring systems.
- Requests from law enforcement or regulators.
- Connection to a jurisdiction subject to special compliance requirements.
You agree to provide accurate information and supporting documentation. We may suspend account activity until verification is complete. We will not knowingly provide the Service to any person or entity subject to applicable sanctions.
7. Fees and taxes
We charge a 4% rake on the winner's profit (the amount won in excess of their original stake). The rake is calculated at settlement and routed on-chain to an Orobas-controlled treasury program-derived account. We may modify the rake rate prospectively with reasonable notice. Wagers already in-flight are settled at the rake rate in effect at the time the wager was placed.
You are responsible for all taxes that may apply to your winnings, including income tax, capital gains tax, and any applicable gaming taxes. We do not withhold or remit taxes on your behalf except where required by law. You may be required to provide tax-reporting information; we may issue tax forms where mandated. 8. Disputes between players and dispute resolution
For coinflip and chess, the outcome is determined by on-chain VRF or chess-engine validation respectively. Outcomes recorded in the Service are presumed correct.
For events, the optimistic oracle process governs outcome determination. If you believe an event outcome was incorrectly proposed or resolved, you may file a dispute through the in-Service dispute interface within the dispute window specified for that event. Disputes filed outside the dispute window will not be considered. The arbitrator's decision on a disputed event is final.
Disputes between you and Orobas. Any controversy or claim arising out of or relating to these Terms, the Service, or your account shall be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER: pending] in accordance with its rules then in effect. Class action waiver. You and Orobas each agree that disputes shall be brought solely in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. [LEGAL REVIEW: unenforceable in some EU states]
9. Intellectual property
The Service, including all software, designs, text, graphics, logos, the Orobas name and sigil, and the underlying smart-contract code, is owned by [ENTITY: pending] or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.
You retain ownership of any content you submit (game history, chat messages, dispute filings). You grant Orobas a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.
10. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law.
- Use the Service to launder money or finance any illicit activity.
- Attempt to gain unauthorized access to any account, system, or network.
- Reverse-engineer, decompile, or disassemble any part of the Service, except where permitted by applicable law.
- Use automated systems, bots, scrapers, or any non-human means to interact with the Service, except for general-purpose web crawlers indexing the public-facing pages.
- Interfere with or disrupt the Service's integrity, including by uploading viruses, executing denial-of-service attacks, or exploiting vulnerabilities.
- Harass, abuse, threaten, or impersonate any other user, our staff, or any third party.
- Use a VPN, proxy, or other technology to circumvent geographic restrictions. See Geographic Restrictions.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
You acknowledge that blockchain transactions are irreversible. Lost private keys, mistyped addresses, smart-contract bugs, and network outages may cause partial or total loss of funds. We do not insure against these risks.

12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OROBAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE DEPOSITED INTO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). 13. Indemnification
You agree to indemnify, defend, and hold harmless [ENTITY: pending] and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.
14. Termination
You may close your account at any time by contacting support@orobas.gg or via the in-app settings page. Account closure does not relieve you of obligations incurred before closure. Your available balance will be returned to your Solana wallet, subject to clearance requirements.
We may suspend or terminate your account at any time, with or without notice, for any reason, including breach of these Terms, suspected fraud, regulatory request, or for the safety of the Service. On termination by us for cause, we may forfeit pending wagers or balances to the extent permitted by law. [LEGAL REVIEW: arbitrary-termination clauses face scrutiny in EU and UK]
15. Modifications to these Terms
We may amend these Terms from time to time. Material changes will be notified to you by email and posted on the Service at least fourteen (14) days before they take effect. Your continued use of the Service after the effective date of an amendment constitutes acceptance of the amended Terms. If you do not agree to the amendment, your sole remedy is to close your account and withdraw your available balance.
16. Governing law
These Terms are governed by the laws of [GOVERNING LAW: pending], without regard to its conflict-of-laws principles. Subject to the binding-arbitration clause in Section 8, you and Orobas agree to submit to the exclusive jurisdiction of the courts of [VENUE: pending] for any matter not subject to arbitration. 17. Miscellaneous
Entire agreement. These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and Orobas regarding the Service.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely.
